Court: Turnpike authority must justify $50 E-ZPass fee

NEWARK, N.J. (AP) - A state appeals court has ordered the New Jersey Turnpike Authority to offer evidence to justify its raising of the E-ZPass violation fee from $25 to $50.

Friday's ruling came in a legal challenge filed by two motorists who claimed the hiking of the fee roughly eight years ago was unreasonable.

The turnpike authority counters that the fee is lower than the cost of processing and collecting toll violations.

The three-judge panel on Friday ruled the authority complied with rulemaking requirements when it raised the fee. But the panel ordered the two sides to hold an evidentiary hearing in front of a judge to resolve the matter.

A spokesman said Friday the turnpike authority was pleased that the judges validated the rulemaking process.
