11-year-old charged with manslaughter of 3-year-old cousin

DETROIT, MI (WJBK) -- An 11-year-old boy has been charged with manslaughter after fatally shooting his 3-year-old cousin.

Prosecutors say the 11-year-old took the gun out of his father's house leading to the shooting of Elijah Walker of Taylor. Wayne County Prosecutor Kym Worthy said she can't remember the last time someone so young has been charged with taking someone else's life.

The parents of the 11-year-old Detroit boy, Kwanna Luchie and Corey Bryson were seen leaving juvenile court Wednesday, while their son will head to trial.

Prosecutors charged the boy with manslaughter and felony firearm. His defense attorney waived his preliminary exam and probable cause hearing.

"We do know that there's two children that are involved," said Larry Fuller, Walker's grandfather. "Eleven years old and three. One is gone and the other one can possibly be gone. "

They say the boy, while visiting his father, took a gun from a bedroom closet, threw it out of the bedroom window and into the backyard. Prosecutors say he grabbed the gun and got into a car parked in his dad's backyard. That was when 3-year-old Elijah got in, too.

"People are quick to say that guns are not the killer, it's the people," Fuller said. "To me guns and people - they go hand in hand."

While no cameras are allowed in juvenile court, the boy's attorney says she is requesting a competency exam. She said the boy is a failing 7th grader at Brewer Academy and doesn't seem competent to stand trial.

"I'm not cognizant of all the problems he's had in his life," Fuller said. "Why his parents aren't trying to correct him as he goes along in life."

Prosecutors Wednesday referenced an incident a week before the deadly shooting in which the boy was apparently confronted by a neighbor with another weapon, and never reported it to police.

"The baby is definitely gone," Fuller said. "You can't bring him back no matter what excuses you have, no matter who did what. The idea is to try to protect each child from every incident that happens."
