AG Kane lawyer, special prosecutor spar before high court

PHILADELPHIA (AP) - A lawyer for Attorney General Kathleen Kane has told the Pennsylvania Supreme Court that a state judge didn't have the authority to appoint a special prosecutor to investigate an alleged leak of grand jury testimony.

But special prosecutor Thomas Carluccio says Kane is only belatedly challenging his appointment because she doesn't like the outcome.

The Supreme Court has released documents showing that the special grand jury that reviewed allegations that Kane leaked grand jury material has recommended perjury, obstruction and other charges against Kane.

Kane attorney Joseph Del Sole argues that the judge should have sent the investigation to a county district attorney.

But Carluccio says his appointment should have been challenged within 10 days. He said Kane doesn't like the investigation's results and "now wants to quash it."
