Prisoner charged in 2003 killing of ax murderer's son, 3

READING, Pa. (AP) -- A man serving time in a Pennsylvania prison has been charged in the 2003 killing of his 3-year-old stepson.

David Charles Cummings was charged Thursday with murder, aggravated assault, rape and other offenses in the death of William Spayd.

The Berks County District Attorney's Office says Cummings confessed to the killing during a police interview in July.

Online court records did not list a lawyer to comment on the charges.

The 50-year-old Cummings has been incarcerated at a state prison outside Philadelphia following burglary and arson convictions in 2004.

Police say Cummings told a 911 dispatcher Spayd was not breathing. The boy's siblings were not injured.

Spayd's biological father is serving 30 to 60 years in prison for killing his mother's former boyfriend with an ax in 2000.
